Subrogation Withdrawal Letter to Adverse Carrier

💡 When to use it

Send this letter to the adverse carrier when your client has decided not to pursue subrogation, for example after the investigation doesn't support liability or the recovery isn't worth the cost. It closes the file cleanly and hands off the evidence.

  • Close the loop in writing. A carrier left hanging keeps a reserve open and keeps calling. A clear withdrawal is a professional courtesy that builds your reputation with other adjusters.
  • Offer the evidence before releasing it. Give the carrier 9 business days to arrange pickup and storage at their own expense. Once they decline or don't respond, your client can release it without a spoliation fight later.
  • Only close your client's claim. The insured may still have their own uninsured losses and may continue their own investigation. Say so plainly so the carrier doesn't treat the whole matter as closed.
  • Don't call it a release. A withdrawal notice is not a signed release. Keep the wording to "no longer pursuing."

Why "our office" matters: Word the withdrawal as our office no longer pursuing, as of the date of the letter. If the client later reopens the claim or sends it to another recovery vendor or counsel, the record shows only that your office had stopped pursuing it at that time. It never says the client gave up its rights.
