💡 When to use it

Send this letter as soon as you know the responsible party's insurance carrier, even before your client's damages are final. It puts the carrier on notice of your client's subrogation interest and gets a claim number and adjuster assigned.

  • Notice first, demand later. This letter opens the file with the carrier. The demand follows once the damages are final and documented.
  • Put the police report number up front. It's usually the first thing the adjuster pulls to review liability.
  • Ask for the basics back. Claim number, assigned adjuster, and contact details, so your follow-up goes to a person, not a mailbox.
  • Offer a joint inspection window. Give the carrier 14 days to ask for one, then diary it. After that, your expert can move forward.

Preservation of evidence

Please instruct your insured to preserve all evidence related to this loss, including [the vehicle, equipment, components, debris, photographs, video, and records]. Neither [Adverse Carrier Name] nor your insured should remove, repair, alter, damage, or discard any of it until all interested parties have had the opportunity to inspect it. If evidence is removed, damaged, altered, or discarded, your insured risks a claim of spoliation of evidence. If you would like to schedule a joint inspection, please contact our office within 14 days of the date of this letter.
